Divorce law in England and Wales

Fortwell Solicitors is based in London, so a case handled here will normally proceed under the law of England and Wales. Since the Divorce, Dissolution and Separation Act 2020 took effect in April 2022, divorce in England and Wales is no-fault. Neither party has to prove wrongdoing, and an application can be made on your own or jointly with your spouse. There is a minimum period of 20 weeks from application to conditional order, then a further 6 weeks before the final order can be made.

Finances are dealt with separately from the divorce itself, and the court has wide discretion to divide assets fairly having regard to the factors in section 25 of the Matrimonial Causes Act 1973. Because that discretion is broad, outcomes vary considerably and early advice on your own circumstances matters.
